Welcome to Berm Life. These Terms of Service ("Terms") govern your use of the Berm Life mobile application and website (berm.life), operated by Berm Life ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: • Provide accurate and complete registration information • Keep your password secure and not share it with others • Notify us immediately of any unauthorized access to your account • Be at least 13 years of age to create an account

You agree not to: • Use the service for any unlawful purpose • Attempt to gain unauthorized access to our systems or other users' accounts • Upload malicious content, spam, or misleading information • Interfere with or disrupt the service or its infrastructure • Scrape, harvest, or collect data from the service without permission • Impersonate another person or entity

Mountain biking is an inherently dangerous activity. Trail conditions can change rapidly due to weather, erosion, construction, and other factors. Berm Life provides trail information, ratings, and conditions as a planning tool only. This information may not reflect current real-world conditions. You are solely responsible for: • Assessing trail conditions before and during your ride • Riding within your skill level and ability • Wearing appropriate safety equipment including a helmet • Following all local trail rules, regulations, and closures • Making your own decisions about safety on the trail You ride at your own risk. We do not guarantee the accuracy, completeness, or timeliness of any trail information provided through our service.

You retain ownership of any content you create through the service, including trip plans, preferences, and profile information. By using our service, you grant us a limited license to store, process, and display your content as necessary to provide the service. We may use anonymized, aggregated data derived from user activity to improve our service, but we will not share your individual trip plans or personal content with third parties without your consent.

The Berm Life name, logo, and all associated content, features, and functionality are owned by Berm Life and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without explicit permission.

To the maximum extent permitted by law, Berm Life and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: • Personal injury or property damage resulting from trail activities • Loss of data or service interruptions • Reliance on trail information, ratings, or recommendations • Unauthorized access to your account or data Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the service will immediately cease.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
